3. Florida-Specific Disclosures & Brokerage Relationships

3.1 Brokerage Relationship Disclosure (Fla. Stat. § 475.278)

Florida law requires real estate licensees to disclose their role in residential transactions:

• Transaction Broker (Default Relationship): Limited representation with duties of honesty, fair dealing, skill, care, diligence, disclosure of known material facts, timely presentation of offers, accounting for funds, and limited confidentiality.
• Single Agent: Requires a written agreement. Duties include loyalty, confidentiality, obedience, full disclosure, and diligent representation of either the buyer or seller (but not both).
• No Brokerage Relationship: When no representation exists, we still owe duties of honesty, fair dealing, disclosure of material facts, and proper accounting.

Important: Florida law prohibits dual agency in residential real estate transactions.

3.2 Property & Seller Disclosures

Sellers must disclose known material defects or conditions affecting the value of residential property that are not readily observable, including but not limited to:

• Structural defects
• Environmental hazards (e.g., mold, lead, radon, flood risk)
• Homeowners’ Association or condominium requirements
• Other facts materially affecting value

3.3 Applicability

These disclosure rules generally apply to residential property of four or fewer units, unimproved residential property intended for four or fewer units, and agricultural property of 10 acres or less.
